Legacy Housing Corporation, as lien holder, is selling 137 mobile homes as 20 sets of homes, each ranging between 2 and 13 homes, located at 6650 Broad Oak Street, Beaumont, TX 77713. These homes were manufactured between 2017 and 2022. The sale will take place at the most northerly door of the Jefferson County Courthouse, 1001 Pearl Street, Beaumont, Texas, on April 10, 2024 at 10:00 AM, or at the place that may be designated by the Jefferson County Commissioner’s Court on the date of sale as the place for conducting non-judicial sales of personal property.
The sale will be conducted by Jones Swenson Auctions as a public auction to the highest bidder for cash, subject to the provisions of the notes and security agreements and Texas law permitting the lien holder to have its bid credited to the note up to the amount of the unpaid debt secured by the security agreement at the time of sale. Those desiring to purchase the property will need to provide a cashier’s check in the amount of $20,000 made payable to themselves in order to register for the auction. All bidders must register and acknowledge they have read and agree to these “Terms and Conditions” of the auction prior to bidding. It is important that you familiarize yourself with the terms and conditions as all sales are final and irrevocable. The terms of sale are non-negotiable. Registration at the auction finalizes each bidder's agreement to the terms and conditions of the sale. Do not bid until you have read the terms and conditions. There is no fee to register, but a deposit is required as set forth below. By bidding you are representing to Jones Swenson Auctions ("Auctioneer") and Legacy Housing Corporation that you have read and agree to be bound by the terms and conditions for this auction as stated herein. Successful bidders will purchase the mobile homes subject to the rights, if any, of existing tenants under Texas and federal law. Successful Bidders are responsible for compliance with Chapter 1201 of the Texas Occupations Code and all Texas Department of Housing and Community Affairs rules.

Inspection/Preview: The mobile homes are not available for inspection since many of them are occupied by tenants. All prospective purchasers must in every way comply with any applicable state or federal law to ensure that no legal or contractual rights of any tenant are violated as a result of any post-sale or pre-sale inspection of the property.
Buyer’s Premium: There is no buyer’s premium at this sale.
Announcements: All announcements made the day of auction take precedence over any and all previously written advertisements or any prior written or verbal terms of sale. Seller reserves the right to withdraw all or any part of the property from auction at any time.
Deposit: All bidders, with the exception of the Lienholder, must deliver a cashier’s check in the amount of $20,000 made payable to themselves to the Auctioneer in order to register for the auction. Successful bidders will be required to endorser the cashier’s check payable to Legacy Housing Corporation. The remainder of the purchase price is due by 10:00 a.m. CDT, April 12, 2024 and must be made by cashier’s check or wire. Additional payment instructions will be provided to successful bidders. A successful bidder’s obligation to pay the purchase price in full and on time is not contingent upon said bidder’s ability to obtain financing. Upon the completion of the auction, all cashier’s checks deposited by unsuccessful bidders will be returned.Bidding Process: The sale will be conducted by Jones Swenson Auctions as a public auction to the highest bidder for cash, subject to the provisions of the notes and security agreements and Texas law permitting the Lienholder to have its bid credited to the note up to the amount of the unpaid debt secured by the security agreement at the time of sale. Possession: Successful bidders may take full possession upon funding of the full purchase price, subject to the rights of any persons occupying the mobile homes and/or the landowner where they are located under Texas law. Successful bidders will purchase the mobile homes subject to the rights, if any, of existing tenants under Texas and federal law. Title: Legacy Housing Corporation will process the titles and forward them to successful bidders via Fed-Ex or certified mail.Relocation of mobile homes: The mobile homes may or may not be occupied by tenants. Successful bidders will be responsible for relocating the mobile homes purchased and/or removing tenants, if necessary. These costs may include disconnecting existing utilities. Tongues, wheels and tires may or may not be attached to the mobile homes. Steps and porches not part of the original home are not included in the sale and should not be removed from the premises. Any purchaser of these mobile homes shall take the collateral subject to any currently valid lease agreements.
Breach or Failure to Close (Default): If any conditions contained herein are not complied with by a successful bidder, or such bidder fails to pay the full purchase price by the stated deadline, the $20,000 deposit will be forfeited as liquidated damages. However, such forfeiture shall not preclude the Lienholder or Auctioneer from enforcing additional remedies available under Texas law.

Auctioneer and Lienholder shall not be liable for any error of judgment or for any act done or omitted by them in good faith. Auctioneer and Lienholder are authorized to act on any document believed by them in good faith to be executed by the proper party or parties, and will incur no liability in so acting. Auctioneer and Lienholder are in all respects and for all purposes third party beneficiaries of this contract to the extent that this contract would entitle them to rights or benefits if they were signatory parties hereto, and each of them is entitled to enforce such rights and benefits, as herein provided, to the same extent they would be entitled if they were such signatory parties. ANY INDEMNIFICATION, DEFENSE OR HOLD HARMLESS OBLIGATION OF BIDDER FOR THE BENEFIT OF AUCTIONEER AND LIENHOLDER IN THIS CONTRACT SHALL SURVIVE THE CLOSING AND/OR TERMINATION OF THIS CONTRACT.
